Terms & Conditions of Sale – Business
When selling Bitus products within Sweden, the terms and conditions according to ABM07 Trävaror (hereinafter referred to as “ABM-Trä”), established by Skogsindustrierna and Svenskt Trä, apply between Bitus and the Buyer.
If the parties have entered into a framework agreement for the purchase and sale of impregnated timber, ABM-Trä applies only to Bitus fire protection, Bitus Linax, and Bitus Thermo (heat-treated). For the impregnated timber, the provisions of the framework agreement entered into between the parties shall apply.
With deviation from the terms stated in ABM-Trä, the following conditions apply to the sale of goods from Bitus.
- 1. “Timber Products / the Timber Product” refers to all goods delivered by Bitus.
- 2. For the handling of Timber Products, the following applies:
Timber products intended for outdoor use must be stored in an outdoor environment, protected from precipitation, and placed flat on a well-drained and sheltered surface to avoid ground moisture, rainfall, and standing water.
The timber must be placed in the shade, as the temperature inside sun-exposed timber packages becomes higher than the outdoor temperature, which may lead to condensation and mould. This in itself increases the risk of microbial growth in the outer layers. Direct sunlight also causes rapid drying of the surface and increases the risk of cracking and warping.
Use several supports underneath to prevent the timber from bending. Tarpaulins must not be placed directly on the timber package, and it is important that they end a bit above the ground, as ventilation inside the timber package must be ensured to avoid condensation and mould.
3. The Buyer’s notice of claim shall be made as follows:
The notice of claim must be submitted in writing within fourteen (14) calendar days from the date the goods were delivered, and must meet the following requirements:
The notice of claim must contain a written and detailed description of the basis for the claim, which Timber Products are concerned, the nature and extent of the defect, the compensation requested, and any other information relevant for the handling of the claim.
If the claim concerns a defect that could not have been detected, or should not reasonably have been detected, by the Buyer during the Buyer’s incoming inspection (“latent defect”), the time limit is thirty (30) calendar days from the date the Timber Products were delivered.
Timber Products subject to a claim must be unprocessed, not consumed, and in the case of larger consignments, only the first package may be opened. When submitting a claim, the customer must specify the reason for the claim, the order number, the package number, the claimed quantity, and attach the relevant photos. During the claim process, the claimed Timber Product must be stored and handled as a prime-quality product.
4. Processing of Personal Data
Personal data provided in connection with the purchase of Timber Products from Bitus — such as name, address, email address, telephone number, date of birth, etc. — will be processed by Bitus for the fulfilment of the agreement. Bitus is obliged to comply with all relevant provisions of the General Data Protection Regulation (GDPR), (EU) 2016/679, and shall therefore:
- Be responsible for ensuring that its processing of personal data is lawful;
- Take the necessary measures to ensure that the personal data is kept protected and not subjected to unauthorised processing, loss, destruction, or damage; and, upon the counterparty’s request, immediately return or destroy the personal data provided by the counterparty.
If you are dissatisfied with how we process your personal data, you have the right to report this to the Swedish Authority for Privacy Protection (IMY), which is the supervisory authority for our processing of personal data. In all other respects, Bitus’ privacy policy applies.

Terms & Conditions of Sale – Export
For export sales of Bitus products, the terms and conditions of the Softwood Contract 2015 (hereinafter referred to as “SWC2015”), established by the Finnish Forest Industries Federation, Skogsindustrierna, Svenskt Trä, and the Norwegian Sawmilling Industry, apply between Bitus and the Buyer.
With deviation from the terms stated in SWC2015, the following conditions apply to the sale of goods from Bitus.
- 1. “Products” refers to all goods delivered by Bitus.
- 2. For the handling of Timber Products, the following applies:
Timber products intended for outdoor use must be stored in an outdoor environment, protected from precipitation, and placed flat on a well-drained and sheltered surface to avoid ground moisture, rainfall, and standing water.

Personal data provided in connection with the purchase of Timber Products from Bitus — such as name, address, email address, telephone number, date of birth, etc. — will be processed by Bitus for the fulfilment of the agreement. We welcome your inquiries and comments. You have the right to know which personal data we process about you and may request a copy. You also have the right to have inaccurate personal data corrected and, in certain cases, to request that your personal data be erased. You may also object to certain types of processing and request that the processing of your personal data be restricted. Please note that restricting or deleting your personal data may mean that we will no longer be able to provide historical communication between you and Bitus.
Bitus is obliged to comply with all relevant provisions of the General Data Protection Regulation (GDPR), (EU) 2016/679, and shall therefore:
- Be responsible for ensuring that its processing of personal data is lawful;
- Take the necessary measures to ensure that the personal data is kept protected and not subjected to unauthorised processing, loss, destruction, or damage; and upon the counterparty’s request, and where such action is compliant with applicable law and not in conflict with Bitus’ legitimate interests, immediately return or destroy the personal data provided by the counterparty.
If you are dissatisfied with how we process your personal data, you have the right to report this to the Swedish Authority for Privacy Protection (IMY), which is the supervisory authority for our processing of personal data. In all other respects, Bitus’ privacy policy applies.

Terms & Conditions of Sale – Consumer
For the sale of Linax oils or other goods delivered by Bitus to Consumers within Sweden, the terms and conditions according to ABM07 Trävaror (hereinafter referred to as “ABM-Trä”), established by Skogsindustrierna and Svenskt Trä, apply between Bitus and the Consumer.
In the event of any conflict between these provisions and the rules set out in the Swedish Consumer Sales Act (2022:260) and the Act (2005:59) on Distance Contracts and Off-Premises Contracts (jointly referred to as the “Consumer Legislation”), the Consumer Legislation shall take precedence.
With deviation from the terms stated in ABM-Trä, the following conditions apply to the sale of goods from Bitus:
- 1. “Timber Products / the Timber Product” refers to all goods delivered by Bitus.
- 2. Handling

Our maintenance oils must be stored frost-free.
3. Product Warranty – Linax Products
For all Linax products, Bitus offers a 50-year rot protection warranty from the date of sale, covering rot, and a 12-year product warranty from the date of sale, covering shape and colour stability, in accordance with the terms set out in Bitus’ Extended Product Warranty. However, this warranty applies in relation to Bitus only if the Consumer has fulfilled the following conditions:
The Consumer acknowledges that Bitus’ responsibility under the Extended Product Warranty is subject to the Consumer having fulfilled the conditions listed below for this extended warranty.
- For Bitus’ Extended Product Warranty to apply, the Consumer is required to register on Bitus’ website under the Linax Rot Protection Warranty.
- By registering on Bitus’ website, the Consumer guarantees that they have read Bitus’ general terms and maintenance requirements.
- The Consumer acknowledges and accepts that Bitus’ Extended Product Warranty applies only on the condition that the general terms and the maintenance requirements have been fulfilled.
4. Claims
Bitus is liable for defects in the product that existed at the time of delivery and that appear within three (3) years from that date. However, the Consumer is obliged to notify the defect without undue delay, and no later than two (2) months from the time the defect was discovered. The notice of claim shall be submitted to the company from which the Consumer purchased the Timber Products.
When invoking a warranty and/or the right to make a claim, the Consumer is responsible for presenting the receipt and any other purchase documentation as proof of purchase.
The Consumer must not further process, refine, assemble, or make any alterations to Timber Products that show visible defects upon receipt. If such processing has begun, the Timber Product is deemed approved and the claim will not be considered. In the case of a claim concerning a larger batch with visible defects, only the first package may be opened. When submitting a claim, the Consumer must specify the reason for the claim, the order number, the package number, the claimed quantity, and attach the relevant photos. During the claim process, the claimed Timber Product must be stored and handled as a prime-quality product.
Bitus handles claims from customers and retailers. For Consumers, we refer you to first contact the building supplier or retailer from whom you purchased your Timber Products, after which the claim will be handled between Bitus and the building supplier/retailer.
5. Right of Withdrawal for Distance Purchases
If the Consumer has entered into the agreement outside Bitus’ business premises through e-commerce, telephone sales or similar, the Consumer has the right to withdraw from the agreement (right of withdrawal) by notifying Bitus of this in writing within 14 days from the day the Consumer took possession of the Timber Product. The Consumer is responsible for the return shipping costs, and the product must be returned in an unchanged condition.
The right of withdrawal does not apply to Timber Products that have been manufactured according to the Consumer’s specifications (custom-made according to the Consumer’s needs and/or wishes and not normally part of Bitus’ standard assortment).
